VERONA >>?More than one-hundred Rome and Verona residents gathered at the Verona Fire Hall Wednesday to devise a plan to prevent an adult nightclub from opening on state Route 365 and Greenway New London Road.
John Nasci and Tom Browka organized the meeting after many community members came fordard to oppose the business during a Rome Common Council meeting earlier this month.
?The biggest concern is what type of people this would bring to the neighborhood,? Nasci said. ?People that would not normally come to this area specifically for drinking and getting involved in adult entertainment.?
Oneida resident Kyle Endemann has a pending purchase offer for a nightclub on the now vacant property, according to his zoning application. The new bar and restaurant he wants to build would be approximately 4,500 square feet with a parking lot for up to 62 vehicles.
But he still needs approval for a bar and restaurant, which isn't a specifically allowed use in the F-1 agricultural zone, according to Daniel Carpenter, assistant building inspector.
Endemann, an Oneida resident, first agreed to speak to the Oneida Daily Dispatch, then stopped returning phone calls.
Nasci, a lawyer, spoke with residents at the meeting about how to tackle the issues from a legal stance.
He explained that in order for the use variance to be granted Endemann must show:
? Financial evidence that he cannot realize a reasonable return without it;?
?unique hardship;? Continued...
?The establishment won?t alter the character of the neighborhood;?
? The hardship is not self-created;?
? The variance will not confer a special privilege to the property that is denied elsewhere in the same district.
Endemann must prove all of these conditions are met.
Nasci encouraged the public to assist with research and organization to better present the their side of the issue at the next Common Council Meeting at Rome City Hall on March 6 at 6:30 p.m.
He asked residents to look into data regarding similar businesses specifically crime rates near Peepers, a strip club in Utica.
Other issues Nasci wanted the public to look into included school bus routes along Route 365, uniqueness of the property, the decline in property value once this type of business opens and proving why the agricultural district is the appropriate zoning designation for the property.
He also asked people to write letters to the Rome Zoning Board as well as Mayor Joseph Fusco, and sign a petition.
Barbara Gold, of Verona, said she plans to write more letters opposing the business. She already sent one to the Rome Common Council a few weeks ago.
?It will really detract from the neighborhood,? she said. Continued...
She added that many municipalities have been cutting back on police coverage.
?Are they going to be able to afford extra police?? Gold asked.
