Part II of this article discussed how individuals historically incorporated their businesses in the hopes of avoiding personal liability, but then often became dissatisfied with the so-called ?double taxation? thereby resulting. This, among other motivations, brought the S-corporation and then, the limited liability company (LLC), into being. As a New York entertainment lawyer practicing in this day and age, I most often see limited liability companies (LLC?s) as opposed to other forms of entities used in film, music, television, publishing, and Internet businesses. However one cannot understand and appreciate the advantages typically provided by the limited liability company (LLC) unless superimposed as bas-relief upon the entity?s historical context ? which gives further meaning to the LLC across all sectors and industries including entertainment and media.

Society clearly benefits from encouraging people to start businesses - and take some commercial risks without an attendant risk of personal ruin. Yet otherwise well-intentioned and well-motivated people were either quitting businesses or exposing themselves to personal liability - in both instances due to their aversion to the so-called ?double layer of taxation? engendered by the C-corp. Additionally, the ?double? taxation of the C-corp was creating a disincentive for new people to go into business - particularly those who were risk-averse. There had to be a better way.

That better way, at the time, was the S-corp, which came into existence a number of years ago principally for the above types of reasons and rationales. It was named after a ?Subchapter-S? in the Internal Revenue Code of the United States, and was regularly recognized by the IRS and state tax authorities alike. One of the familiar tasks for an entertainment lawyer became the act of ensuring that clients timely made their appropriate S-corp elections (see below) with appropriate governmental authorities ? hardly the romantic notion one would have of what it is like to interact with talent and go to celebrity premieres..

Akin to the C-corp in most other respects, the S-corp only mandated a single layer of taxation, as opposed to the C-corp?s double layer of taxation. But there were also a few catches.

One had to make a formal written ?election? (or in some cases, ?elections?) to qualify as an S-corp. If one didn?t do so in time by a strict deadline, one would lose S-corp status and be ?doubly? taxed like a C-corp instead. As most entertainment lawyers can attest, this kind of eventuality could actually snuff out a fledgling entertainment or media start-up business in its first years of existence, already engaging in risky and speculative business activity as is often the case in media and entertainment.

There were other restrictions on S-corps, too, such as a limit on the number of shareholders, a limit on foreign ownership, and a limit on corporate parent-subsidiary ownership. Some of these restrictions have been loosened - and in some cases eliminated - in recent years; so one should not rule out the S-corp without first updating its tax code requirements with one?s lawyer ? entertainment lawyer or otherwise ? as well as one?s tax accountant. The historical restrictions of the S-corp put business owners in a ?Catch-22? situation - they clearly wanted a single layer of taxation, but in the context of an entity that wasn?t so restricted. The newer solution: scrap the idea of a corporation at all, and instead form a limited liability company, or LLC.

The limited liability company (LLC) is akin to the S-corp but without most of the attendant historical restrictions. Yes, there were a certain number of restrictions on the LLC, too, when it first appeared on the scene - most of which were subsequently lifted by either the IRS or state legislatures, or both. Again, S-corp restrictions have also been lifted in recent years, making the S-corp and limited liability company (LLC) look more similar to each other as time goes on.

But even as of this writing, the limited liability company (LLC) is usually considered the most advantageous entity from a tax perspective of all 3 most commonly available forms, for the small business owner to create. As a media and entertainment lawyer, the LLC is the entity which I am most often asked to create. The LLC is also considered the most flexible of all 3 entities. What does ?flexible? mean? Well, it is considered easier to adapt the LLC to later-occurring additional equity-holders in one?s business, for example, which is another familiar task for an entertainment lawyer in the context of artistic co-ventures - and the word ?easier? in this context translates to ?less legal fees?. The LLC is in most cases an entity which is easier to manage and administrate.

There are some disadvantages to the limited liability company (LLC), too. The LLC can take more time to finalize, and in some cases can be more expensive to form and/or file with the government - as compared to an S-corp. Some states historically prohibited 1-person LLC?s. Some states still have an underdeveloped body of judicial case law on the LLC, since the entity is still quite new in many states - so the treatment of the LLC under the law may be less certain than the treatment of a corporation. We in New York have an odd restriction, too, as a result of the powerful newspaper and media lobby galvanized during the legislation?s enactment which as a media and entertainment lawyer I suppose that I should not begrudge. This restriction may be present in another state or two as well in analogous form. The restriction is this: if one elects to form a New York LLC, one must publish its existence in periodicals for a number of weeks, before being accorded the legal privilege of initiating a litigation - as a plaintiff - in the LLC?s name in the New York courts. Publication of an LLC?s naissance in Manhattan is expensive - the publication of a limited liability company in periodicals of the creation of a proposed Manhattan LLC can range between $1,000 and $3,000 (the figures can vary and are smaller in other parts of New York State apart from Manhattan).

Even so, the limited liability company (LLC) is considered the trend-setting entity of those ?in the know?, across the country. As an entertainment lawyer in New York, I have noticed that hipster Californians gravitate to LLC?s just as much as hipster New Yorkers seem to do. And part from hype, assuming that one can afford to form an LLC, and assuming that one can live with whatever restrictions apply to the LLC in one?s jurisdiction, it may in fact be the entity of choice, and an improvement over the older S-corp and C-corp structures.

A limited liability company (LLC), though frequently mistaken for a corporation, is technically not considered a corporation ? rather, it is an unincorporated entity under the tax code, more like a partnership than anything else, but one that (like the S-corp and C-corp), if properly formed and maintained, should provide its members with insulation against personal liability.

If one doesn?t incorporate or form a limited liability company (LLC), the business will likely be what is known as either a sole proprietorship (if a 1-person company), or a general partnership, de facto or otherwise, (if comprised of 2 or more persons). Any entertainment lawyer or other lawyer will opine that this could result in unlimited personal liability for the entity?s owner or owners. Again, that means that an owner?s personal assets can be at risk to satisfy the obligations and debts of the business. Any entertainment lawyer or other lawyer will opine that personal liability is not a risk worth taking. In addition, using a corporate entity or limited liability company (LLC) ? particularly an LLC in this day and age - could add a good deal of ?cachet? or credibility to one?s business endeavors, in the eyes of other persons and companies with whom the business has contact.

Ventura said, "Government should not be telling people who to fall in love with."

    The San Francisco 49ers became the <a href="http://www.huffingtonpost.com/2012/08/24/san-francisco-49ers-it-gets-better-campaign-_n_1828488.html">first NFL team to make a video</a> for the "It Gets Better Project," in August. Other sports teams who have made videos include L.A. Dodgers, Philadelphia Phillies, Tampa Bay Rays, Baltimore Orioles, Boston Red Sox, Chicago Cubs, and the San Francisco Giants.

    GOP Fiscal Cliff Offer: Chained CPI - Business Insider

    UPDATE:

    According to NYT's Jonathan Weisman, the GOP has pulled its previous proposal for a Chained CPI.

    Earlier: As you can see in our Fiscal Cliff liveblog the negotiations are at an impasse, reportedly because the Republicans have tossed in a demand that Social Security benefits be cut.

    They don't actually call it a "cut" but rather a change to how benefits are indexed. Currently benefits rise every year in step with CPI. The GOP wants it to rise in step with an alternative measure of inflation called the Chained CPI. Dylan Matthews at Wonkblog has a good in-depth explanation of how the Chained CPI works, but the gist is that the Chained CPI tries to take more into account how people substitute cheaper/inferior products when the price of their preferred goods rise.

    It's not a preposterous notion to change how Social Security is indexed, but as Josh Barro noted in a great Bloomberg View piece, there's no question that changing the indexing is a benefits cut.

    So back to today's talks.

    Here's the key sequencing you need to know.

    Obama said on Meet The Press that a Chained CPI is an example of something he could get behind (in terms of spending cuts) that showed he was serious about not giving into the far left of his party (the left wing hates the idea of a chained CPI).

    Now Democrats are saying that the GOP insistence on including this is a poison pill.

    Republicans are hammering Democrats for this inconsistency. MSNBC's Joe Scarborough said in a tweet: "This morning President Obama bragged about taking a tough stand on Social Security. This afternoon Harry Reid took his offer off the table."

    But the key point here is that Obama is only going to give in on entitlement cuts if it's part of a "grand bargain" that sees significant GOP concessions on taxes. What's infuriating Democrats is that the Chained CPI is being tossed in as part of a late "small bargain."

    So that's where we're at with this story. It could all be irrelevant in a bit.

    CAIRO (Reuters) - Egypt's opposition accused President Mohamed Mursi's Islamist allies of trying to muzzle dissent on Friday after prosecutors decided to investigate whether prominent government critics were guilty of sedition.

    The probe, which comes a month after Mursi replaced the chief prosecutor, further sours the political climate as the leader and his opponents face off over a new constitution that became law on Wednesday.

    Critics of the new charter say it uses vague language, fails to enshrine the rights of women and minorities and does little to champion the rights of Egyptians who rose up last year to overthrow army-backed strongman Hosni Mubarak.

    Supporters say it protects personal rights that were often trampled upon during the Mubarak era and a subsequent spell of army rule.

    The constitution text won about 64 percent approval in a two-stage referendum but Mursi's opponents vowed to continue protests and rejected his calls for a national dialogue.

    Prosecutors ordered the inquiry into three of the president's most prominent opponents on Thursday - former Arab League chief Amr Moussa, Nobel Peace Prize laureate Mohamed ElBaradei and leftist Hamdeen Sabahy.

    Moussa and Sabahy both challenged Mursi for the presidency in a June election which followed the 2011 uprising.

    The prosecutor's office said the three had been accused of inciting supporters to rise up and overthrow Mursi, the country's first fairly elected leader.

    Mursi's critics saw an attempt to intimidate them into silence and vowed to continue challenging his rule.

    "I believe this is orchestrated by the Brotherhood leadership," Hussein Abdel Ghani, a spokesman for the country's main opposition umbrella group, told Reuters. "The Mubarak regime used to order the same tactics."

    "But we are going to use our full rights, our civil tactics, to demonstrate our opposition to this regime," he said.

    The charged atmosphere makes it harder for Mursi to bolster his authority and muster a consensus for unpopular austerity measures vital to preventing a weak economy from collapsing.

    AN END TO TURMOIL

    Mursi is hoping that the quick adoption of the constitution and holding elections to a permanent new parliament soon will help end the long period of turmoil since Mubarak's overthrow in February 2011 that has wrecked the economy.

    But the Egyptian pound tumbled to its weakest in almost eight years this week after the constitution was approved. People unnerved by the continued political tension rushed to hoard dollars and gold.

    The government ordered new restrictions on foreign currency apparently designed to prevent capital flight. Leaving or entering with more than $10,000 cash is now banned.

    Mursi was propelled into office thanks to the rallying power of his Muslim Brotherhood, the country's main opposition group under Mubarak that was banned from formal politics for decades.

    Ahmed Sobeih, a spokesman for the Brotherhood's Freedom and Justice Party, dismissed Abdel Ghani's accusation of an organised legal campaign against Mursi's opponents.

    "We must get away from the language of mutual accusations," he said, adding that "dozens" of similar complaints had been filed against Brotherhood leaders.

    Mursi appointed Chief Public Prosecutor Talaat Ibrahim when he assumed sweeping new powers on November 22. Ibrahim's predecessor, Abdel Maguid Mahmoud, had served for many years under Mubarak.

    Judicial sources said the inquiry against Moussa, ElBaradei and Sabahy followed a complaint from lawyers sympathetic to Mursi.

    The trio are part of the National Salvation Front, an alliance of political groups that has spearheaded street protests against the government.

    "The mere referral of these complaints to an investigative judge and the accompanying public announcement is already cause enough for serious concern," said Heba Morayef, Egypt director at New York-based Human Rights Watch.

    A spokesman for Moussa said the accusations against him were groundless.

    "What we read in the papers are several allegations that we have denied over and over in the past few months," said Ahmed Kamel, a spokesman for Moussa's Congress Party. "They are completely unfounded and have no relation to reality."

    Whether facing off in the national championship game, playing in the Final Four, or just meeting in the regular season, the two programs on opposite sides of the country have created compelling matchups.

    The undefeated teams will renew their annual contest Saturday when the second-ranked Huskies (10-0) visit the No. 1 Cardinal (11-0).

    "It's a rivalry for us, but more than that, it's a measuring stick," said Stanford coach Tara VanDerveer, whose Cardinal have held the top spot in the poll for the past six weeks. "When the ball goes up, nobody cares anything about rankings."

    The last time the teams met in the Bay Area in 2010, the Cardinal ended the Huskies' NCAA record 90-game winning streak. UConn will try and return the favor by snapping Stanford's streak of 82 straight home victories.

    "It's going to be two really competitive teams, it's going to be a dogfight," UConn senior Kelly Faris said. "Two years ago that's what it was."

    On the boards, Stanford's 6-foot-3 Chiney Ogwumike will battle with UConn's 6-5 Stefanie Dolson and 6-4 freshman Breanna Stewart. The younger sister of All-American Nneka Ogwumike, who graduated from Stanford, is averaging 21.8 points and 12.8 rebounds for the Cardinal.

    Stewart is averaging a team-high 16.6 points and 7.2 rebounds, while Dolson is contributing 11.7 points and 6.0 rebounds per game.

    It marks the 51st meeting between the top two teams in the poll. The No. 1 seed holds a 31-19 lead. UConn and Stanford have been in three of those contests over the past few seasons with the Huskies winning all of them.

    "The 1 versus 2 thing makes for better TV, but it doesn't change how we prepare," Stanford's Toni Kokenis said. "We are defending our home court, regardless of the opponent. But yeah, we ended their streak two years ago and I'm sure they want to do the same thing to us."

    Stanford hasn't lost at Maples Pavilion since March 18, 2007, when Florida State beat the Cardinal in the second round of the NCAA tournament. UConn brought its streak to Stanford almost exactly two years ago only to see the Cardinal stop it with a 71-59 win in front of an enthusiastic crowd. VanDerveer expects a similar atmosphere Saturday.

    "We're excited we're playing here," VanDerveer said. "Our team has played very well, but that's not the deciding factor. You have to make baskets and rebound and make stops. We know it's what you do on the court."

    The Huskies, who beat Stanford in Hartford by 10 points last season, aren't concerned about ending the Cardinal's streak. They are just trying to improve.

    "I don't think I'd go out there with the mindset that we have to break their streak," Faris said. "It's another game. But the whole streak thing, if you focus on that, you're not going to be doing the right thing."

    Both coaches are aware that it's just one game in December with conference play about to start after the New Year.

    "If you win on Saturday you know you beat a really good team," UConn coach Geno Auriemma said. "If you lose you know you got a lot of work to do to beat a really good team down the road."

    Connecticut leads the series 7-6, including winning five of the last eight meetings ? dating back to 2005. Stanford, unlike a lot of other teams in the country, has been able to stay close to the Huskies in the losses, losing most by a dozen points or less.

    "You have two of the best offensive teams in the country, not to say we're going to see who can win 110-109," he said. "We try to make scoring and scoring often our priority. Maybe that's why it's become such a great rivalry."

    Unlike other rivalries in the sport that have ended during the past few years because of conference realignment or teams refusing to play each other, UConn and Stanford will continue for at least two more seasons. They will open next season in Connecticut.

    "As long as Stanford wants to play we'll play them. I have a lot of respect for them, obviously, as a university and certainly their coaching staff," Auriemma said. "They're great people. And the kind of people they recruit are great people. So I'm thrilled that it was done. Really. I think that's a great thing for us."

    After playing Stanford, UConn will head to Oregon before going home to open up its Big East schedule.

    "Playing games on the road at the early part of the season is very important," Auriemma said. "Coming out here and playing Stanford and knowing how hard it is to play them, especially here. It's a great opportunity for us at this point in the season. As soon as we're done on this trip we have Notre Dame at home. Playing two teams in the top five in the country in a matter of a week or so is exactly what we need right about now."

    Thai 'Yellow Shirt' leaders charged for 2008 rally

    BANGKOK (AP) ? Protest leaders in Thailand were indicted Thursday for storming the prime minister's office compound and sealing off Parliament during massive anti-government rallies in 2008 at the height of political turmoil, which left the country deeply divided to this day.

    Prosecutors filed charges against Sondhi Limthongkul, Chamlong Srimuang and other leaders of the People's Alliance for Democracy, also known as the Yellow Shirts.

    They face up to five years in prison for trespassing at Government House during an August 2008 rally, in which protesters stormed the compound and thousands occupied the grounds for weeks. They face an additional seven years in prison for blockading the Parliament in an October 2008 rally that left hundreds injured.

    They also led a two-week seizure of Bangkok airports but have not yet been charged for that.

    Mostly hailing from the urban elite, the Yellow Shirts' protests grew from their visceral hatred for former Prime Minister Thaksin Shinawatra, a telecommunications tycoon, whose democratically elected government was in power from 2001 until it was overthrown in a 2006 military coup. The Yellow Shirts claimed he was corrupt and that his proxies were running the country after he went into exile following the coup.

    His sister, Yingluck, is now premier, which critics say has helped accelerate long-stalled legal cases against opponents of Thaksin, who says the corruption charges that he says are trumped up.

    After a year of martial law following the 2006 coup, fresh elections were held that were again won by Thaksin's allies, triggering the Yellow Shirt protests, which took a heavy toll on the economy and tourism. The political turmoil continued for months until the pro-Yellow Shirt Democrat Party formed a government in December 2008 without an election. That brought to the streets tens of thousands of Thaksin supporters, mostly rural folk, who called themselves the Red Shirts.

    They were evicted from central Bangkok in a military operation in April 2010 that left dozens of people dead.

    The deadlock was finally broken when the Democrat Party stepped aside and called elections in July 2011 that Yingluck's party won. Thaksin remains in exile.

    While many of us were opening presents and having our fill of mulled cider, NASA's trusty Curiosity rover was busy at work capturing panoramic views of Yellowknife Bay, a shallow area of unusual terrain on the Red planet. Jokingly dubbed "Grandma's house" by the crew, the rover spent over 11 Martian days there so that handlers could take some time off for the holidays. When they get back, the space vehicle will hopefully have provided enough data to pinpoint a potential drilling area so it can drill, collect and analyze rock samples using onboard tools -- a feat never-before attempted on Mars.

    The Curiosity rover has, however, checked in on Foursquare on Mars, which is a feat no one else is likely to attempt. In continued collaboration with the social media platform, NASA is now providing a Curiosity Explorer badge to anyone who checks in to a NASA visitor center or a venue categorized as a science museum or planetarium. Badge recipients will get this message: "Get out your rock-vaporizing laser! You've explored your scientific curiosities just like NASA's Curiosity rover on Mars. Stay curious and keep exploring. You never know what you'll find." No idea if you'll get a free "scoop" of space ice cream or a hand in the next Mars mission along with it, but we're behind anything that boosts the public's interest in space.

    My favorite part is the redevelopment of obsolete brownfield sites and turning them into productive commercial projects that provide jobs and a stable rateable for the community. The most challenging aspect of this industry is the entitlement process in high barrier to entry markets.

    Q: How have economic conditions affected J.G. Petrucci?s strategies? Have you widened or narrowed your focus due to present conditions??

    We are more conservative with use of debt. We remain opportunistic, but underwrite each project more conservatively.

    Q: J.G. Petrucci has experience with a variety of property and development types. Since the recession began, has any particular market or property type surprised you with its performance (for better or worse)?

    The multi-family developments have performed extremely well because the market has neglected new residential rental products for the better part of the last 30 years. Suburban office is very weak. I believe this is a function of the changing nature of the work place for corporations.

    Q: Tell us about your work with brownfield sites. What challenges and opportunities do you see with such projects? How has your background in law helped with your work on such projects?

    Every project we work on has a brownfield component. Environmental conditions create imperfection in pricing, creating potential for value if you are able to mitigate the conditions efficiently. Brownfields are a highly regulated aspect of the business and my legal background helps navigate through the many layers of legal requirements.

    ?Q: How about green technology and the LEED certification process? What challenges and opportunities come with sustainability-focused projects?

    Green technology is here to stay. We incorporate more and more eco-friendly elements to our projects every time we have the opportunity. The challenge of LEED certification is incorporating these important concepts but maintaining a project budget. Many projects are expensive and have to be incorporated carefully over time.

    The majority of our clientele is on the private side, however, when we do work with public entities we find them to be very inefficient.

    Offices will continue to contract as technology improves and there will be more need for urban development near public infrastructure.

    Q: If you didn?t work in the Mid-Atlantic market, what region would you be interested in exploring?

    Possibly Chicago and the Midwest region of the United States.

    Will Kate Winslet become Kate Rocknroll?

    So everyone knows women don't have to change their names when they get married, but come on, Kate Winslet, don't you want to be "Kate Rocknroll"?

    Winslet's wedding earlier this month was a surprise, but more surprising to many was the name of her groom: Ned Rocknroll.

    The wedding was a hush-hush ceremony, so it's not clear if his musical last name was engraved in careful calligraphy on Crane invitations. And Winslet will likely continue to act under her current name, since she didn't change it when she wed Jim Threapleton or Sam Mendes.

    As you might guess, "Rocknroll" isn't her new husband's real name. He was born Ned Abel Smith, but don't mind that fairly generic last name. There's a more famous name in his family tree -- he's the nephew of Sir Richard Branson, founder of Virgin Group, and works for Virgin Galactic, which hopes to sell flights into space in the near future. (His title is reportedly "head of astronaut relations and marketing," which is almost as good as "Rocknroll.")

    The name change came about in 2008. "The whole thing was about having fun with your name," his then-wife, Eliza Pearson, told the British newspaper The Daily Mail.?"He thought we all took ourselves too seriously so it was about reacting against it.?He looked into just being ?Ned?, with no surname at all but, apparently, that?s illegal so we couldn?t do it."

    Pearson (no word on whether she was ever known as "Eliza Rocknroll") told the paper she learned about the legal name change one day when her then-fiance emailed her a photo of his new passport.

    "It was hysterical. We had discussed him doing this many times before, but I wasn?t sure whether he?d do it," she said.

    A photo of their 2009 wedding shows the bride and groom posed between four friends who are bending over, rear ends to the camera, and who have the letters ROCKNROLL written on their white pants.

    He's not the only celebrity to change their last name to something unusual. Football player Chad Johnson changed his last name to "Ochocinco" in 2008. "Ocho cinco" translates as "eight five," and 85 ("ochenta y cinco") is Johnson's Cincinnati Bengals' uniform number. He changed it back in 2012.

    The study suggests that management strategies that reduce the local use of pavement and increase natural habitat within the landscape could improve nesting opportunities for wild bees and help protect food supplies around the word.

    The study also suggests that increasing the number of species-rich flowering patches in suburban and urban gardens, farms and restored habitats could provide pathways for bees to forage and improve pollination services over larger areas.

    The findings have major implications for global pollinator conservation on a rapidly urbanizing planet.

    "We are potentially in a pollinator crisis," said Shalene Jha, lead author and assistant professor of biology at The University of Texas at Austin. "Honey bees are declining precipitously, and wild bees have also been exhibiting population declines across the globe. Native bees provide critical pollination services for fruit, nut, fiber and forage crops. Understanding how bees move around the landscape can help us both preserve biodiversity and improve crop yields."

    Animal pollination is estimated to be worth over $200 billion in global crop yields.

    For the research, published in the Proceedings of the National Academy of Sciences, Jha and senior author Claire Kremen, a professor at UC Berkeley's Department of Environmental Science, Policy and Management, studied a native California bumblebee, Bombus vosnesenskii, in habitats across exurban areas, farms and nature reserves.

    In addition to finding that pavement negatively affects the bees, the scientists discovered that:

    • Bees will move longer distances to find patches of flowers that are rich in species; it's not floral density that determines how far a bumblebee will fly, but floral diversity.
    • Bees will also forage further away from their home nest if the surrounding landscape is less heterogeneous. "In some ways, it's a bet-hedging strategy," said Jha. "If the landscape is composed of consistently dense flowering patches, bees take a risk and forage farther afield to find species-rich patches."

    "In combination with earlier work showing that bumblebees have become rare in agricultural landscapes, our study suggests that farmers could promote these valuable pollinators by diversifying crop types and by planting cover crops and flowering hedgerows to enhance floral diversity," said Kremen.

    Though it may seem obvious that pavement and ground nesting don't mix, Jha said that our understanding of the effects of pavement and urban growth on native bees has been largely anecdotal.

    "Using genetic tools, we can now estimate the number of colonies in an area," said Jha, who began this work as a postdoctoral researcher at UC Berkeley. "This is helping us better understand how wild pollinators live and move across large, diverse landscapes."

    Bumblebees nest in the ground, and each colony contains a queen and a force of workers. As with honeybees, all of the bumblebee workers are sisters who spend some of their time flying around searching for flowers from which to collect pollen and nectar to feed the larvae back in the hive.

    Unlike honeybees, which are not native, bumblebees do not make harvestable honey. They do, however, provide important pollination services to plants.

    "Bumblebees are among the most effective native pollinators," said Jha. "They are large and can carry a lot of pollen. They also vibrate or 'buzz' flowers with their bodies and thus are excellent at extracting pollen and moving it from plant to plant."

    To study the bumblebees, Jha did not scour the landscape for nests in the ground, which has proved in the past to be very difficult, especially over large areas. Instead, she analyzed the genetic relatedness of bees foraging in the landscape.

    If bees collected in an area were genetically identified as sisters, they came from the same colony. Unrelated bees came from different colonies. Jha used this information, plus the bees' locations, to estimate the number of bee colonies in an area and determine how far afield the individual bees were foraging.

You can get your degree in graphic design, furniture design, architectural design, or interior design and then go for a Masters in automotive design. This path would be appropriate if you are making a career change an area of the design to another.     (AP) ? The pieces of the puzzle that have been the Lakers' confounding season so far are starting to fall into place.

    Kobe Bryant engineered a second-half comeback, the defense stepped up, and Los Angeles beat the New York Knicks 100-94 on Tuesday, extending its winning streak to five games.

    "We're .500," a smiling Dwight Howard said. "We did it on Christmas, too. I knew this day would come."

    Bryant scored 34 points in his NBA-record 15th Christmas Day game and Metta World Peace added 20 points and seven rebounds while defending Carmelo Anthony, whose 34 points led the Knicks. Anthony said he hyperextended his left knee, but expects to play on Wednesday in Phoenix.

    Bryant, the league's leading scorer, has topped 30 or more points in nine straight games.

    "If you're going to play on Christmas, it's always better to win. Makes it all worthwhile," said Bryant, who would soon hop a flight to Denver, getting there ahead of the Nuggets, who played the Clippers in the other half of the holiday doubleheader at Staples Center.

    The Lakers improved to 14-14 ? 9-9 under new coach Mike D'Antoni ? and upped their holiday record to 21-18, including 13-9 at home. They returned to .500 for the first time since they were 8-8 on Nov. 30.

    "It's so early in the season to have turned a corner," Bryant said. "We have everybody in the lineup and we're starting to see how we want to play."

    The Knicks controlled most of the game behind Anthony and J.R. Smith, who had 24 points. But they struggled offensively in the fourth, when Anthony was limited to seven points and Smith had five as the Lakers' defense clamped down. World Peace fouled out with 1:58 to play and the Lakers ahead by four.

    World Peace credited his defense on Anthony to "old-school basketball."

    "I'm back in shape and it's a little tough to guard me," he said.

    Steve Nash said: "This is what he's been doing all year. He gets his hands on a lot of balls, pounds on the other team's best guy. You can't win without that type of effort."

    Smith's 3-pointer pulled New York to 96-94. After Pau Gasol made one of two free throws, Smith missed another 3 that would have tied the game at 97 with 32 seconds left.

    "We missed a lot of easy shots, a lot of little chippers around the basket, shots that we normally make," Anthony said. "There were some plays that we thought should have went our way down the stretch, but for the most part, we fought. I'll take this effort any night. If we continue to play with this effort, we'll win a lot of games."

    With Bryant double-teamed, Nash passed to Gasol, who dunked with 12 seconds to go, punctuating a win that sent Lakers fans, frustrated by the team's struggles and coaching change, home happy. The Lakers avenged a 116-107 loss in New York on Dec. 13.

    A smiling Howard called Gasol's driving slam "a submarine dunk because he was very low to the ground."

    Gasol responded, "I don't dunk as often as I used to so it felt good. I took it right down the lane and finished strong."

    Nash had 16 points, 11 assists and six rebounds in his second game in nearly two months. He missed 24 straight games while recovering from a small fracture in his lower left leg. Howard had 14 points and 12 rebounds, and Gasol had 13 points and eight rebounds.

    "It was an important win for us as we were a little bit desperate," Nash said. "We've gone through a lot since Mike Brown ? new coach, new offense. It's been a difficult transition."

    Bryant had eight of the Lakers' first 10 points to open the fourth during a run that provided their first lead since the opening quarter in a game matching the two teams that have played the most on Christmas Day.

    They took the lead for good on Bryant's basket with 7:38 remaining. Anthony and Tyson Chandler were in foul trouble in the fourth, with Chandler fouling out late.

    "They just were a little bit more aggressive," Anthony said. "Kobe got it going and Steve Nash hit some big shots down the stretch. When you have a guy like Nash doing that, it's kind of tough. Those guys know how to play. They've been waiting for Steve Nash to get back, so it's just a matter of then sticking it out until he did."

    The Knicks opened the third on a 15-5 run, with Anthony setting up on the perimeter and hitting two 3-pointers as part of his 10 points that stretched their lead to 61-53. His jumper provided the Knicks' largest lead of the game, 69-60.

    Bryant and Nash ignited the quiet atmosphere by leading a 17-9 run that drew the Lakers to 78-77 going into the fourth. They combined to score 15 points, although Bryant missed two free throws to end the third that would have given the Lakers their first lead since early in the game.

    The Knicks' earlier roll dissolved in missed shots and a technical on Chandler for arguing a call.

    "We were more determined, fought for everything," Nash said about the second half.

    World Peace scored 16 points in the second quarter, including eight in a row, when the Lakers played catch-up most of the way. His 3-pointer gave the Lakers their first lead of the period with 1:10 remaining. Smith tied it up with a free throw before Nash's jumper sent the Lakers into halftime leading 51-49.

    "We're playing really well together," World Peace said. "Kobe is really playing excellent now. He's still being aggressive on the offensive end, but he's giving everybody a chance to be aggressive. Pau is making strong, aggressive moves."

    Bryant scored the Lakers' final nine points of the first quarter to give them a 25-23 lead. D'Antoni's plan of having Darius Morris guard Anthony didn't last long after he scored five of the Knicks' first seven points.

    "I thought he'd get warmed up before he started firing," World Peace said.

    NOTES: Bryant surpassed Oscar Robertson as the league's all-time Christmas Day scorer with 383 points. Robertson had 377. ... Knicks F/C Amare Stoudemire shot some before the game. He's been out all season after left knee surgery. "I'm not quite there yet, but I'm making progress," he said. "I've just got to stay patient and stay ready. We've been doing extremely intense work, as far as cardio." ... Knicks C Marcus Camby had four points and four rebounds in 8 minutes.
