(AP) ? Argentina has lost its long battle in US courts to justify its refusal to pay so-called bond holdouts who didn't accept pennies on the dollar for defaulted debt years ago.

An appellate court in New York on Friday rejected a dozen appeals that Argentina filed over the years, and ordered the South American country to pay the holdouts an equal amount whenever it makes payments on other debt restructured since the country's economic collapse a decade ago.

The holdouts say Argentina owes them $1.33 billion in unpaid principal and interest.

Argentina has paid other bonds since then but has refused to deal with the holdouts, who in turn have gone after Argentine assets worldwide, including the navy's signature tall ship Libertad, now detained in Ghana.

Exxon gets key permit for Alaska's Point Thomson field

ANCHORAGE, Alaska (Reuters) - Exxon Mobil Corp on Friday received a major federal permit it needed to start construction on the Point Thomson oil and gas field on the eastern North Slope of Alaska, officials said, after an extended delay that threatened some leases there.

The U.S. Army Corps of Engineers granted Exxon a wetlands-fill permit for construction of drill pads, roads, an airstrip, pipeline, and docking and other facilities needed for production at the long-languishing field - production the state of Alaska has accused the company of dragging its heels on.

The Army Corps permit followed a detailed environmental impact study that began in 2009. While there remain a few outstanding state permits, the wetlands-fill authorization was the major approval needed for construction, said Mike Holley, northern branch team leader for the state's Army Corps district.

Holley said Exxon, backed by partners BP Plc and ConocoPhillips , hopes to begin construction soon.

"They are planning on doing as much of the construction this winter as possible," he said, adding that ice roads, which are built by spraying water on the tundra, would accommodate that.

Production was expected to be about 10,000 barrels per day of liquids, starting in the winter of 2015-2016, Exxon spokeswoman Kim Jordan said in an email - timing that would be a year later than once expected. Jordan declined to comment on when construction would start.

Point Thomson has been the subject of long-running dispute between the state of Alaska and the oil companies. The state contended the companies were improperly delaying development at the field, where leases date back to the 1960s. The state began procedures to revoke the leases so they could be re-auctioned.

"I applaud both Exxon and the Army Corps for staying at the table and working out this permit," Senator Mark Begich, an Alaska Democrat, said in a statement.

The field holds an estimated 8 trillion to 9 trillion cubic feet of natural gas and hundreds of millions of barrels of oil and natural-gas condensates, state officials say. Exxon and its partners argued development was challenged by extraordinary high-pressure conditions in the reservoir, among other factors.

In March, the state reached a comprehensive settlement with Exxon and its partners. Prior partial settlements resulted in new exploration drilling and plans for production of liquids.

The companies had targeted a 2014 start, but the environmental impact study process took longer than expected, Holley said. It took a long time for the Army Corps to select action alternatives, and once the draft EIS was issued, there was more reaction than expected, he said, citing about 1,600 requests for modifications.

The project is in an area important to polar bears and to local Inupiat Eskimo hunters. Holley said many commenters sought to avoid conflicts with subsistence food-gathering.

Hundreds turn out for hospital merger deliberations in Brunswick ...

BRUNSWICK, Maine ? Hundreds of people turned out Wednesday for a hearing about the proposed merger between Central Maine Healthcare and Parkview Adventist Medical Center.

The hearing is part of the Department of Health and Human Services? Certificate of Need process, which is the mechanism the state uses to consider major changes or investments in the state?s health care system.

Parkview and CMHC filed a lengthy CON proposal earlier this year. Mid Coast Hospital, which is located a few miles from Parkview in Brunswick, filed a competing application seeking to take over Parkview, but was told by DHHS?s Division of Licensing and Regulatory Services that its proposal was not reviewable under the state?s CON law.

The hearing kicked off at 10 a.m. Wednesday at the Knights of Columbus Hall in Brunswick with a capacity audience, many of whom wore stickers or held signs in support of either Parkview or Mid Coast Hospital.

Valerie Caron of Harpswell, who has worked in Parkview?s pharmacy for 29 years, was one of several people standing outside the meeting, waving signs that said, ?Take me to Parkview,? which is a familiar slogan on bumper stickers in the Brunswick area, and ?Parkview is Here to Stay.?

Caron said the hospital printed up the signs but that her involvement in Wednesday?s hearing was voluntary.

?Parkview is a wonderful place,? said Caron. ?We need to have a choice in Brunswick. We?re not saying Mid Coast Hospital is a bad place, but we?re already halfway merged with [Central Maine Healthcare].?

Chuck Gill, vice president of public affairs for CMHC, kicked off what was scheduled to be an all-day hearing.

?We?re going to talk a lot today about why hospitals are joining larger systems throughout the country,? said Gill. ?Anyone involved in health care understands that this system is getting more and more and more complex. Stand-alone hospitals are really becoming outliers.?

Mike Ortel, chairman of the Parkview board, said that hospital has wanted to join with CMHC for more than a decade ? and not with Mid Coast.

?Control of Parkview has never been out to bid,? said Ortel. ?We have told Mid Coast ?no? multiple times over the past 30 years because of who we are and what we stand for. Our future looks good and we have no desire to go away.?

Others disagreed and said a merger between Parkview and Mid Coast is what?s best for the community. Ralph Perry said he has been involved in fundraising for both hospitals.

?Mid Coast is truly a community hospital for this area,? said Perry. ?In 2012, this community faces changes that will definitely affect the future of health care for all of us. It is imperative that we work together.?

The CON approval process is expected to take several more weeks. Written comments will be accepted until 5 p.m Nov. 26. They can be mailed to DHHS, Division of Licensing and Regulatory Services Health Care Oversight Unit, Station House 11, 41 Anthony Ave., Augusta 04333-0011.

Ukraine under fire in Russian activist's abduction

KIEV, Ukraine (AP) ? Ukraine let Russian agents kidnap an anti-Kremlin activist seeking asylum in the Ukrainian capital of Kiev and forcibly bring him back to Moscow, the main opposition party charged Thursday.

The party led by jailed former Prime Minister Yulia Tymoshenko claims that President Viktor Yanukovych sanctioned the abduction of Leonid Razvozzhayev in order to secure the Kremlin's backing for Sunday's parliamentary election in Ukraine.

"The special services of a foreign state are operating on Ukraine's territory," said Tymoshenko ally Arseniy Yatsenyuk.

Yanukovych, who visited Moscow earlier this week, has been courting the Kremlin to seek a rebate on Russian natural gas supplies. A lower gas price is essential to keep the struggling Ukrainian economy afloat and would secure public support for Yanukovych and his party.

Razvozzhayev, a 39-year-old Russian opposition activist, had come to Kiev last week to seek political asylum in Ukraine after Russian investigators accused him of being involved in plotting anti-government riots.

Razvozzhayev told Russian human rights defenders who visited him in a Moscow jail that he was kidnapped on a Kiev street by masked men who smuggled him into Russia. He said they kept him in handcuffs and leg chains in a basement for three days, denying him food, water, sleep or use of a toilet. He also said they threatened to kill his children until he "confessed" to plotting riots.

Russian authorities say Razvozzhayev turned himself in and confessed voluntarily.

Razvozzhayev's lawyer, Mark Feigin, said on Ekho Moskvy radio Thursday that his client has formally disavowed his confessions and filed a complaint over his abduction to Russia's main investigative agency.

Ukraine's Foreign Ministry and the national security agency have declined to comment on the matter. But Interior Ministry spokesman Volodymyr Polishchuk on Thursday allowed for the possibility that Russian security services could have been involved in Razvozzhayev's abduction.

"How did it happen? Did they ask him to (go) of his own free will? Or did they just force him? I don't know," Polishchuk told The Associated Press.

Either way, Polishchuk said, what happened to Razvozzhayev did not constitute a crime because he is "alive and well" and the Interior Ministry will not press charges.

"This is not the province of the police. The police deal with criminal actions," he said.

Yatsenyuk vowed that the opposition would press for a parliamentary probe into Razvozzhayev's case.

Human Rights Watch, meanwhile, has urged Ukraine to thoroughly investigate Razvozzhayev's abduction.

"For an asylum seeker to simply vanish while lodging his asylum claims and then reappear in the country he fled is profoundly shocking," said Hugh Williamson, Europe and Central Asia director at Human Rights Watch. "There needs to be a serious investigation to determine whether any Ukrainian officials were involved and to hold accountable any who played a role."

The Office of the U.N. High Commissioner for Refugees also voiced concern about Razvozzhayev's fate, emphasizing Thursday that he was protected by international refugee law as an asylum-seeker.

The agency said it was seeking Russia's clarification of Razvozzhayev's condition and status and warned Ukraine that it must make sure that asylum seekers aren't exposed to personal risks.

The Russian Foreign Ministry responded angrily after the U.S. Embassy in Moscow voiced concern about Razvozzhayev's case, rejecting the U.S. statement as "hasty" and "improper" and noting claims that the CIA had tortured some detainees.

Razvozzhayev's case was reminiscent of the disappearance last year of a Palestinian engineer from a Ukrainian train. He surfaced in an Israeli prison several days later to face terrorism charges. Kiev has still failed to explain how that happened.

(AP) ? Water from a leaking boiler collected just outside a room that was supposed to be sterile. Floor mats used by technicians were filled with dirt and debris. Drugs were shipped out before the company even confirmed they were sterile.

State officials said Tuesday that they found these and other problems at the New England Compounding Center during a preliminary investigation into the company, linked to a deadly outbreak of meningitis.

The probe can't yet conclusively prove what caused the outbreak, a top health official said. In the meantime, Massachusetts Gov. Deval Patrick said he wants to tighten oversight at similar companies, including with surprise inspections ? the first of which happened Tuesday.

The state has also moved to permanently revoke the company's operating license, as well as the licenses of its top three pharmacists.

"Those whose laboratory practices caused this outbreak should never practice pharmacy or manufacture in Massachusetts again," Patrick said.

The outbreak of fungal meningitis, an inflammation of the lining of the brain and spinal cord, has sickened 308 people, including 23 who have died, in 17 states. The outbreak has been linked to a steroid made by the NECC and taken mainly for back pain. Compounding pharmacies like NECC custom mix solutions in doses or forms generally not commercially available.

The federal government is conducting a criminal investigation.

The state said Tuesday that its preliminary investigation, which began last month after the company was first suspected in the growing outbreak, found batches of drugs ready for general distribution but not labeled for specific patients.

Its state license permits the company to fill out only specific prescriptions for specific patients, and distributing drugs in batches like a manufacturer would violate that, said Dr. Madeleine Biondolillo, director of the state Department of Public Health's Bureau of Healthcare Safety.

But company attorney Paul Cirel said it's "hard to imagine" state regulators weren't previously aware of the scale of its operations because they've worked so closely together. The state Board of Registration in Pharmacy has always had complete access to the facility, and board members were there as recently as last summer, he said.

"NECC's transparency in dealing with the board since inception in 1998 demonstrates its good-faith intention to operate in compliance with the requirements of its license," Cirel said.

Besides possible state license violations, Biondolillo said the inspections also revealed "several health and safety deficiencies" at the NECC facility in Framingham, just west of Boston.

Three lots of steroids produced by the company are suspected in the outbreak, and the company shipped orders from those lots 13 times before receiving the results of its own tests to confirm those lots were sterile, Biondolillo said. Some medication was shipped as many as 11 days before the company received test results, she said.

Biondolillo also detailed signs of flawed sterilization procedures, including black specks of fungus in sealed vials of the steroids, which were returned to the company during a recall.

Investigators found the company didn't sterilize its products long enough and didn't adequately test whether its sterilization equipment was working, she said.

In addition, mats on which people wiped their shoes to remove contamination before entering a sterile environment were "visibly dirty and soiled with assorted debris," she said. And a leaking boiler adjacent to a pharmacy clean room left an unsanitary pool of water around it and the adjacent walls, she said.

As the investigation continues, Patrick's moves to increase oversight at the state's 25 compounding pharmacies have started.

The first of the unannounced inspections, to take place at least annually, was done on Tuesday, health department spokesman Alec Loftus said. He wouldn't give the inspected facility's name and said the results are being reviewed.

Patrick also said compounding pharmacies will now be required to file annual compliance reports that could help regulators determine if they are acting as manufacturers.

BBC ripped for handing of sex abuse scandal

The predatory pedophilia of a former British radio and TV celebrity has shaken the BBC to its foundations, as the broadcaster struggles to reconcile itself to charges of mismanagement and allowing an "unacceptable culture" of sexual abuse to go unchecked for decades.

Jimmy Savile, who died in October 2011 two days before his 85th birthday, rose to fame in the 1960s as a dance-hall promoter and later BBC radio disc-jockey. In the 1970s, 80s and 90s, he was a regular fixture of the BBC TV schedules, where his popular, family-oriented shows attracted top ratings. He was honored by the queen, networked with politicians and celebrities and was feted for his charity fundraising and good works.

But in the months since Savile's death, a catalog of accusations has emerged, stretching from 1959 to 2006, in what London's Metropolitan Police described as "abuse on an unprecedented scale."

It has also come out that Savile's sexual exploitation of children may have been known to some people at the time, including former colleagues and managers at the BBC, who failed to report or act upon the rumors and accusations. What's more, it has been revealed that in late 2011, the BBC axed an investigative news item into Savile's pedophilia at the same time that it was planning a Christmas tribute program to him.

UK in turmoil after multiple claims kids' entertainer molested children for years

The head of the BBC denied on Tuesday helping to cover up the allegations but accepted that it had been damaged by the crisis.

In a BBC TV documentary broadcast Monday night, Panorama investigated the original news item, which was to have aired on BBC TV's Newsnight program until it was shelved by the Newsnight editor.

By accessing the original Newsnight video and interviews, Panorama drew a portrait of Savile as a shrewd, calculating and devious predator who preyed on vulnerable young people. Among the accusers were some victims who said Savile had sexually abused them in his BBC dressing room after he recorded his TV shows.

Panorama also looked into the circumstances that led to the Newsnight item being dropped.

Suggestions that it was dropped as part of a BBC cover-up were refuted in a blog by the program's editor, Peter Rippon,?who wrote, "I was told in the strongest terms that I must be guided by editorial considerations only and that I must not let any wider considerations about the BBC affect my judgement."

However, on Monday Rippon "stepped aside" from his post as the BBC issued a correction?to his blog, in which it became clear that Rippon had made factual errors about what the BBC had known. In particular, the correction clarified that there were "some allegations of abusive conduct on BBC premises."

'Broader cultural problem'
BBC director-general George Entwistle was quizzed on Tuesday about all of this by a parliamentary select committee?into the BBC's handling of the affair.

Although he denied the BBC was facing "its worst crisis in 50 years", Entwistle said Savile's alleged behavior had been possible only because of a "broader cultural problem" at the BBC.

When pressed by parliamentarians for detail, Entwistle told them, "We are looking at between five and 10 serious allegations relating to activities over the whole period in question, the Savile period." He added the allegations included claims of sexual harassment made against people still working at the BBC, but could not say how many.

The director-general's grilling created an impression of BBC management out of touch with the broadcaster's day-to-day running.

Instead of evidence of management interference in editorial matters, committee members described themselves as "astonished" at the "lack of curiosity" exhibited by senior management into rumors and "water-cooler" revelations.

The BBC has announced two independent reviews into the Savile affair: one looking at how the abuse he is accused of could have been allowed to happen, and the other looking into the circumstances of the shelved Newsnight item.

Meanwhile, the police enquiry into Savile's activities has developed into a criminal investigation which has yet to establish the full extent of his crimes. Police are following more than 400 lines of enquiry involving more than 200 potential victims.

Death toll from West Nile virus tops 200: government

DALLAS (Reuters) - The U.S. outbreak of West Nile virus has killed 219 people this year, after another 36 deaths from the mosquito-borne disease were reported last week, government figures showed Wednesday.

In what is the second-worst year on record for the disease, the total number of cases of West Nile virus across the United States grew to 4,725, with 194 new cases reported, according to the Centers for Disease Control and Prevention.

Although the pace of new cases has slowed since the outbreak's peak in the late summer, new cases continue to be reported, particularly in states where warm temperatures persist. This year's outbreak has trailed only 2003 in total cases.

Just over half of the cases reported to the CDC this year have been of the severe neuroinvasive form of the disease, which can cause meningitis and encephalitis.

The death toll from West Nile is now the highest since 2003, when 264 deaths were reported. The highest number of deaths from West Nile was 284 in 2002.

CDC officials have said deaths often lag weeks to months from the time of infection because of lingering illness.

Almost 70 percent of the cases have been reported in eight states: Texas, California, Louisiana, Mississippi, Illinois, South Dakota, Michigan and Oklahoma.

More than a third of all cases have been reported in Texas, with Dallas-Fort Worth at the center of the outbreak.

The Texas Department of State Health Services has reported 1,683 cases and 77 deaths, including 915 cases and 36 deaths in the Dallas-Fort Worth area.

Is declining medical imaging use driving up hospital stays and medical costs?

ScienceDaily (Oct. 23, 2012) ? A new report by the Harvey L. Neiman Health Policy Institute shows that the length of the average hospital stay in the United States has increased at the same time as use of medical imaging scans has declined. It is unclear if the trends are related, but potentially important, as hospital admissions are among the largest, and fastest growing, health care costs. More research is needed to assess the potential negative impact of government and private insurer imaging reductions on overall medical costs and patient safety.

"Lawmakers, regulators and medical professionals are making medical imaging policy decisions without fully understanding or examining their downstream effects -- which may include an increase in hospital stays, associated costs and other adverse events. We need to examine imaging, as it relates to a patient's overall continuum of care, to ensure that decision makers don't create imaging cost reduction policies which paradoxically raise overall costs, create barriers to care, and ultimately harm patients," said Richard Duszak, MD, chief executive officer and senior research fellow of the Harvey L. Neiman Health Policy Institute.

Much of a building body of research regarding medical imaging focuses on declining costs and utilization of imaging. There is relatively little research focused on imaging as a component of overall patient care. For many serious indications, imaging scans have been shown to reduce the number of invasive surgeries, unnecessary hospital admissions and length of hospital stays. Rarer still is data on the effect of $6 billion in funding reductions for imaging diagnosis and treatment planning since 2006. The information that is available is not necessarily positive in terms of patient safety and access to care.

This is the first policy brief produced by the Neiman Institute, which conducts and supports research regarding medical imaging use, quality and safety metrics, and human resources as medicine moves toward non-traditional, value-based payment and delivery. The data gleaned from these efforts will serve as the basis for true, evidence-based medical imaging policy.

"We need to take a hard look at the cost, access and quality and safety issues related to present government and private insurer medical imaging policies and find ways to maximize the value, role and efficiency of radiology as health care systems evolve. The Neiman Institute will provide much needed information to ensure that future imaging policies benefit patients and make efficient, effective use of health care resources," said Duszak.

Energy-sensing switch discovery could have broad implications

ScienceDaily (Oct. 21, 2012) ? Biochemists at The Scripps Research Institute (TSRI) have discovered a genetic sequence that can alter its host gene's activity in response to cellular energy levels. The scientists have found this particular energy-sensing switch in bacterial genes, which could make it a target for a powerful new class of antibiotics. If similar energy-sensing switches are also identified for human genes, they may be useful for treating metabolism-related disorders such as type 2 diabetes and heart disease.

"This discovery adds a new dimension to our understanding of how cells sense and manage their energy levels, which is one of the most important processes in biology," said the study's senior author, Martha J. Fedor, a professor the departments of Chemical Physiology and Molecular Biology and a member of the Skaggs Institute for Chemical Biology at TSRI.

The findings are described online ahead of print on October 21, 2012, in the journal Nature Chemical Biology.

A Fuel Sensor

This type of gene-switching sequence is known as a riboswitch because it appears on the strand of ribonucleic acid (RNA) that is first transcribed from a gene's DNA. Unlike other known riboswitches, which have relatively limited functions, this one acts as a sensor for the basic molecular fuel that powers all living cells and controls many genes.

The newly discovered riboswitch detects a small molecule known as adenosine triphosphate (ATP), the standard unit of chemical energy in all known organisms on our planet. Scientists had thought that cells use only large and relatively complex proteins to sense these all-important energy molecules and adjust cell activities accordingly. No one had found ATP sensors among riboswitches, which can alter cell activity at a more fundamental level -- usually by interrupting a gene's transcription from DNA.

Moreover, previously described riboswitches are relatively simple feedback sensors that affect narrow metabolic pathways. Most of them merely sense and adjust the expression rate of their own host gene. "This is the first riboswitch that is known to be involved in global metabolic regulation," said Fedor.

In recent years, the Fedor team had found hints that such a riboswitch could exist. Many RNA sequences with possible riboswitch activity had never been characterized, and several riboswitches in bacteria sense molecules that are closely related to ATP. Fedor and a graduate student in her laboratory, Peter Y. Watson, therefore set out to find bacterial riboswitches that could indeed sense ATP.

Caught in the Act

The task was more challenging than it might have seemed. Watson could not simply expose suspected riboswitches to ATP and see which ones stuck best to the energy molecules. ATP is present in high concentrations in cells, and its interactions with its known protein sensors are necessarily fleeting, low-affinity affairs. Interactions with a riboswitch would be expected to look the same. "Such interactions are really too weak to be detected using traditional methods," Watson said. But he found evidence that an RNA interaction with an ATP-like molecule would occur in a way that allows the brief coupling to be caught in the act -- using a burst of ultraviolet radiation, which can create a strong chemical crosslink between two molecules.

In this way, he discovered a stretch of apparent ATP-binding RNA known as the ydaO motif. Watson performed structure-mapping analyses of ydaO to confirm that it binds to ATP and to determine precisely where it binds. Attaching ydaO to a "reporter" gene, he found that in bacterial cells, the reporter gene's expression level stayed low when ATP levels were normal and rose sharply when ATP levels dropped -- as would be expected if ydaO is really an ATP-sensing riboswitch. Even in unaltered cells of a test bacterium, B. subtilis, levels of the genes that normally contain the ydaO motif rose and fell in the same way in response to changing ATP levels.

The ydaO motif occurs in the large subset of bacteria known as gram-positive bacteria. Across these bacterial species, it has been found, to date, on 580 separate genes. "These ydaO-regulated genes encode proteins that have a wide variety of functions, from cell wall metabolism to amino acid transport," Watson said. "It makes sense that a riboswitch in control of such disparate processes would be responding to a central metabolite such as ATP."

New Possibilities

The finding has basic scientific importance because it is the first known example of a riboswitch that binds ATP; it is also the first known riboswitch that has such broad regulatory functions. "It opens up the possibility that RNA switches are involved in the general regulation of metabolism," said Fedor.

The fact that ydaO motifs serve as "off-switches" for key bacterial genes also makes them a potential target for new antibiotics. "Hitting these riboswitches with a small-molecule, ATP-mimicking drug so that they can't turn on genes that promote bacterial growth and survival could be a viable approach," said Fedor.

Her laboratory will now search for other ATP-sensing riboswitches in bacteria and in higher organisms, including humans. A human ATP-sensing riboswitch, if targeted appropriately by drugs, might be able to alter cell activity in ways that help treat common metabolic disorders. Type 2 diabetes, which presently affects several hundred million people worldwide, is known to feature the improper regulation of ATP levels in cells.

Funding for the study, "The ydaO motif is an ATP-sensing riboswitch in Bacillus subtilis," was provided by the Skaggs Institute for Chemical Biology at TSRI.

Egypt freezes assets of ex-candidate, ex-PM Shafiq

CAIRO (AP) ? Egyptian authorities on Sunday said they are freezing the assets of presidential candidate and former prime minister Ahmed Shafiq and his daughters as part of the investigation into his wealth.

The decision by the Illicit Gains Authority is the latest legal move against Shafiq, who held senior posts under deposed president Hosni Mubarak. He faces trial on corruption charges.

Shafiq ran in Egypt's first presidential elections after Mubarak's ouster, narrowly losing to Muslim Brotherhood candidate Mohammed Morsi.

Soon afterward he left the country with his family.

The authority said in a statement that investigations show Shafiq has real estate and financial assets including 12 villas, four chalets and two apartments.

Shafiq has repeatedly denied allegations and said the case against him is politically motivated.
